Property Owner Association (POAs) or Home Owners Association Management (HOAs)

How is an HOA different to Sectional Title?
 
Sectional Title schemes are created and managed under the national Sectional Titles Act, 1986. However, home owners' associations in South Africa are not governed by any national legislation. They are either established in terms of section 21 of the Companies Act or as common law associations, created to manage particular communities, often "gated" and operated separately from the surrounding properties. Property Owners Associations vary in size and complexity. Some POA’s exist almost in name alone but others share infrastructure, facilities and are often gated. They are generally governed by a Constitution and are managed in a similar manner to Sectional Title Schemes with a Board of Trustees making the days to day decisions and generally rely on the services of a professional property manager. 
 
POA’s provide a convenient way for developers to stage and design developments according to demand. For example a single POA will consist of a mix of single title properties and Sectional Title schemes. 
 
The skills required to effectively manage a POA are similar to those that are required by a Sectional Title Manager or administrator.
